On January 6, 1977 defendant Terrance Alan Petko was arrested and subsequently charged in the District Court, Deer Lodge County, with two counts: Felony possession of marijuana and possession - Page 231 with intent to sell. The second count was subsequently dropped during trial. The case was tried to a jury, defendant was found guilty and given a deferred imposition of sentence under the condition that he pay $500 within six months. From this sentence defendant appeals and alleges six specifications of error:
